Legal victory for Iraqi Citizen In Hooding Row

Alaa' Nassif Jassim al-Bazzouni, an Iraqi citizen from Basra in the south-east of the country, has won a groundbreaking legal case over the way in which he was treated by British soldiers in 2006.rnal-Bazzouni claimed that, during the fight to overthrow dictator Saddam Hussein, he was hooded and maltreated by the occupying forces and that it was the British governments’ own guidelines that allowed this to happen. rn

rnrnThe guidelines that existed at the time of the incident in question allowed British officers to put a ‘hood’ (generally a sandbag) over the prisoners head during transit or transportation however the High Court in London ruled that this was type of action was unlawful. rnThere has been new guidelines published for British officers since 2006 and the practice of ‘hooding’ has been outlawed however British soldiers and intelligence officers, while not permitted to do the act themselves, are able to cooperate with security forces that have not outlawed this practice.

rnrnIndeed, the practice of ‘hooding’ being used within the UK was banned in the 1970’s after it was used on terrorist suspects during the troubles in Northern Ireland however it was not outlawed for British forces using the tactic abroad.

rnrnAlaa' Nassif Jassim al-Bazzouni and his lawyer both claim that the new guidelines issued by the Ministry of Defence do not completely eradicate the practice of hooding by British forces as, even though they are not permitted to carry out the act themselves, they can fully cooperate with those that do on the basis that they detainee’s life is not in danger.
